Today the Supreme Court ruled that municipalities have the unbridled power to regulate medical marijuana dispensaries within their borders. This power includes the ability to ban all dispensaries. What this means is that 90% of the cities in California will disallow the operation of medical marijuana facilities.
The only way to overcome such a ruling is to seek relief through the electoral process via an initiative. In cities where initiatives are already taking place, like Los Angeles, today’s decision highlights why it is so important that no artificial cap is placed on the operation of medical marijuana dispensaries. In LA, if Measure D were to pass, once a dispensary closed it would no longer be allowed to operate and no new dispensary would be allowed to replace it either. Eventually, there would be no more access for the sick and elderly.
All collective and dispensaries need to work together to succeed from this point out.
