Activists file petition to overturn L.A.’s medical marijuana ban

Advocates of medical marijuana are submitting a petition Wednesday to force a ballot referendum to overturn a Los Angeles City Council ban on dispensaries that was to go into effect Sept. 6.


Activists collected 50,000 signatures from voters, well over the 27,425 needed to put the issue on the ballot. The petition, to be filed with the L.A. City Clerk’s Office, will call for a referendum next March on the new ordinance banning marijuana dispensaries.


The City Council voted in July to ban storefront dispensaries, citing conflicting court opinions about whether the city can legally regulate marijuana collectives. However, the ordinance would allow licensed patients or caregivers to grow and transport their own medical marijuana.


The ban affects more than 1,000 dispensaries, which were sent letters to shut down by Sept. 6 or face a $2,500 fine for every day they remain open past the deadline.


The petition Wednesday would temporarily suspend the ordinance. The City Clerk's Office has three days to count signatures and 15 days to verify the signatures against voter registration information. If the petition qualifies, it will be sent to the L.A. City Council, which can repeal the ordinance, call for a special election in the next 110-140 days or put it on the March 5 ballot.


Medical marijuana supporters say they support regulations on marijuana dispensaries but the ordinance, which was supported by Mayor Antonio Villaraigosa and Police Chief Charlie Beck, goes too far.


Medbox Inc.(Pink Sheets: MDBX), a Hollywood-based medical equipment distributor, issued a statement Wednesday lauding the petition.The company said it supports measures to allow a 90-day registration period where any medical marijuana outlet can legally register with the city after meeting certain criteria. The criteria should be that the outlet is the proper distance (1,000 feet) away from schools, public parks, and playgrounds; pay a $5,000 registration fee to the city; and submit fingerprint samples for screening to insure that operators are not convicted felons, the company said.


"Cities that guarantee safe and regulated access to medical marijuana for patients avoid an unregulated environment that leads to fraud as well as diversion of the drug to non-medical users,” Vincent Mehdizadeh, founder and chief executive of Medbox unit Prescription Vending Machines Inc. said in the statement.
